Nosizwe Concepts Terms and Conditions
Effective date: 20 July 2026
These Terms and Conditions apply to the use of the Nosizwe Concepts website and to quotations, orders and purchases made from Nosizwe Concepts.
By using our website, accepting a quotation, approving artwork or placing an order, you agree to these Terms and Conditions.
Nothing in these terms is intended to exclude or limit any rights that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”) or other applicable South African law.

2. Our products and services
Nosizwe Concepts supplies products including:

Corporate uniforms and workwear;

Hospitality and chef uniforms;
-
T-shirts, golfers, jackets and promotional clothing;
-
Aprons and related products;
-
Custom-made garments;
-
Embroidery, printing and other branding; and
-
Promotional products.
Some products are manufactured by Nosizwe Concepts, while others may be sourced from third-party suppliers.
3. Quotations
Unless otherwise stated, quotations are valid for the period shown on the quotation. If no period is shown, the quotation is valid for seven calendar days.
A quotation is based on the information available when it is prepared. Prices or lead times may be revised if:

Quantities, sizes, products or colours change;
-
Branding requirements or artwork change;
-
Supplier prices or stock availability change before payment;
-
Additional work is requested; or
-
Information supplied by the customer is incomplete or incorrect.
A quotation does not reserve stock or secure production capacity until the required payment has been received and the order has been formally accepted.
4. Prices and VAT
Prices are displayed or quoted in South African rand.
The quotation or checkout page will state whether VAT is included. Courier charges, branding, artwork preparation and other services may be charged separately unless expressly included.
Although we take reasonable care to ensure that prices are correct, genuine pricing or description errors may occur. If an obvious error affects an order, we will notify the customer and offer the option to proceed at the correct price or cancel the affected order for a refund.
5. Orders and acceptance
An order is treated as accepted once:

The customer has approved the quotation or completed the online order;

The required payment has been received;
-
Product specifications have been confirmed;
-
Stock or materials are available; and
-
Artwork has been approved where branding is required.
Nosizwe Concepts may decline or cancel an order where:
-
A product or material is unavailable;
-
There is an obvious pricing or description error;
-
The requested design is unlawful, offensive or infringes another person’s rights;
-
We reasonably suspect fraud or unauthorised payment; or
-
We cannot reasonably complete the order as requested.
If we cancel an order after receiving payment, we will refund the amount paid for the cancelled portion.
6. Payment
Full payment is required before production, sourcing or branding begins, unless alternative payment terms have been agreed in writing.
Orders will not be released, dispatched or collected until all amounts due have been paid.
Banking details should always be verified directly with Nosizwe Concepts before making payment. We will not be responsible for payment made into an incorrect account where the customer failed to verify a suspicious or changed banking instruction, except to the extent that the loss resulted from our negligence or legal responsibility.
7. Product information
We make reasonable efforts to display product descriptions, measurements and colours accurately. However:

Screen colours may differ from physical fabric colours;

Dye batches may have minor variations;
-
Product specifications may change between supplier batches;
-
Measurements may have reasonable manufacturing tolerances; and
-
Images may include accessories that are not part of the product.
Customers should request a physical sample before production if an exact colour, fabric or fit is essential.
8. Sizes and measurements
Customers are responsible for checking the applicable size chart before approving an order.
Sizing may differ between brands and garment styles. A size selected from one range may not have the same measurements as the equivalent size in another range.
Where the customer supplies measurements, Nosizwe Concepts will manufacture according to those measurements. We will not be responsible for an incorrect fit caused by inaccurate measurements provided by the customer.
Customers should request assistance before ordering if they are uncertain about sizing.
9. Branding and artwork approval
Branding will only begin after the customer has approved the final artwork or branding layout in writing.
Approval may be provided by email, WhatsApp, electronic message or another recorded method.
The customer must carefully check:

Spelling and grammar;
-
Names and telephone numbers;
-
Logo design and colours;
-
Branding size;
-
Branding position; and
-
Product colour and quantity.
Nosizwe Concepts will not be responsible for an error contained in customer-supplied or customer-approved artwork.
The appearance of embroidery, printing or other branding may vary slightly according to the product, fabric, branding method and screen display.
10. Customer logos and intellectual property
The customer confirms that they own or have permission to use any logo, name, image, trademark or artwork supplied to Nosizwe Concepts.
The customer may not ask us to reproduce material that unlawfully infringes another person’s intellectual-property rights.
The customer agrees to be responsible for reasonable claims or losses arising from material supplied without the necessary permission, except where Nosizwe Concepts knew or reasonably should have known that the use was unlawful.
Nosizwe Concepts retains ownership of its original designs, patterns, templates, photographs, website content and other intellectual property unless ownership is expressly transferred in writing.
11. Samples and pre-production items
Samples, prototypes and pre-production products may be charged for.
A sample is intended to demonstrate the general product, colour, construction or branding. Bulk production may have minor reasonable variations from the sample.
Approval of a sample authorises Nosizwe Concepts to proceed according to the approved specifications.
12. Production and lead times
Estimated lead times are:
-
Standard, unbranded products: 5-7 working days
-
Custom-made or branded products: 7–10 working days
-
Bulk orders: 10–14 working days
Lead times begin on the next working day after:
-
Full payment has cleared;
-
All order information has been received; and
-
Final artwork has been approved.
These are estimates and may vary depending on quantities, supplier availability, production requirements and circumstances outside our reasonable control.
If a fixed event date is important, it must be disclosed and accepted by Nosizwe Concepts in writing before the order is placed.
13. Changes to confirmed orders
Any requested change after payment or approval must be submitted in writing.
Changes are subject to approval and may result in:

Additional charges;
-
A revised completion date;
-
New artwork or sample charges; or
-
An inability to change goods already ordered, cut, branded or manufactured.
Nosizwe Concepts will confirm the cost and effect of a requested change before proceeding.
14. Cancellations
Standard orders may be cancelled subject to applicable law and any reasonable costs already incurred.
Special-order, branded, altered or custom-made goods generally cannot be cancelled once sourcing, cutting, manufacturing or branding has begun, except where applicable law provides otherwise.
Where cancellation is permitted, Nosizwe Concepts may deduct a reasonable cancellation charge based on work completed, materials ordered and other actual costs incurred.
This clause does not remove any cooling-off or cancellation right that applies under the CPA or ECTA.
15. Delivery and collection
Delivery is governed by our separate Shipping Policy.
The customer must provide complete and accurate delivery information. Additional courier fees may apply where delivery fails because the address or contact details supplied were incorrect or nobody was available to receive the parcel.
Customers collecting an order must wait for confirmation that it is ready. Collection is by prior arrangement from our Westville premises.
16. Returns, exchanges and defective products
Returns, exchanges and refunds are governed by our separate Return and Refund Policy.
Branded, altered, custom-made or special-order products cannot generally be returned because of a change of mind, incorrect customer-supplied information or an incorrect size selected by the customer.
This does not limit the customer’s rights concerning defective, unsafe or incorrectly supplied products under applicable law.
17. Care instructions
Customers must follow the care instructions supplied with the product or displayed on its label.
Damage caused by the following will not ordinarily be considered a manufacturing defect:

Incorrect washing or drying;
-
Bleach or unsuitable chemicals;
-
Excessive heat;
-
Incorrect ironing;
-
Normal wear and tear;
-
Accidental damage;
-
Misuse; or
-
Alterations performed by another person.
Certain branding methods require specific washing and ironing precautions.
18. Promotions and discount codes
Promotions are subject to their stated validity dates, product availability and specific promotional conditions.
Unless otherwise stated:
-
Promotions cannot be combined;
-
Discount codes cannot be exchanged for cash;
-
Discounts do not apply retrospectively;
-
Only one discount code may be used per order; and
-
Promotional products remain subject to availability.
19. Website accounts
Customers are responsible for keeping account login details confidential and for activity conducted through their accounts.
Please notify us promptly if you believe that an account has been accessed without permission.
We may suspend an account where we reasonably suspect fraud, misuse or a security risk.
20. Acceptable website use
You may not:

Use the website unlawfully;
-
Attempt to gain unauthorised access to the website or its systems;
-
Introduce malicious software;
-
Copy or commercially exploit our website content without permission;
-
Submit fraudulent orders or information; or
-
Interfere with the website’s operation.
21. Third-party services and links
Our website may use or link to third-party payment, courier, social-media or other services.
These services may be governed by separate terms and privacy policies. Nosizwe Concepts is not responsible for an independent third party’s website or services, except where applicable law makes us responsible.
22. Privacy
Personal information is processed according to our Privacy Policy and applicable data-protection legislation.
By placing an order, you authorise us to share the information reasonably required by suppliers, branding providers, payment processors and couriers to complete the order.
23. Limitation of liability
To the fullest extent permitted by law, Nosizwe Concepts will not be responsible for indirect or consequential loss that was not reasonably foreseeable when the agreement was concluded.
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability arising from gross negligence or any statutory rights under the CPA.
Nosizwe Concepts’ responsibility will be assessed according to the circumstances and applicable South African law.
24. Events outside our reasonable control
Nosizwe Concepts will not be treated as having breached an agreement where performance is prevented or delayed by circumstances outside our reasonable control, including:

Natural disasters or severe weather;
-
Fire, flooding or civil unrest;
-
Strikes or transport disruptions;
-
Power, internet or system failures;
-
Supplier or courier disruptions;
-
Government restrictions; or
-
Material shortages.
We will take reasonable steps to notify affected customers and minimise the delay. If performance becomes impossible or is delayed for an unreasonable period, the parties’ rights will be determined under applicable law.
25. Complaints and disputes
Please contact Nosizwe Concepts first so that we can try to resolve the matter directly.
Complaints should include:

The customer’s name and contact details;
-
The invoice or order number;
-
A clear description of the issue; and
-
Relevant photographs or supporting documents.
Nothing in these terms prevents an eligible consumer from approaching the Consumer Goods and Services Ombud, the National Consumer Commission, a competent court or another appropriate authority.
26. Governing law
These Terms and Conditions are governed by the laws of the Republic of South Africa.
Subject to any consumer’s right to approach another competent forum, disputes may be dealt with by a court with jurisdiction in KwaZulu-Natal, South Africa.
27. Changes to these terms
Nosizwe Concepts may update these Terms and Conditions when its products, website, business practices or legal obligations change.
The updated terms will apply from the date published. Changes will not unfairly alter an order already accepted unless agreed with the customer or required by law.
28. General provisions
If any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
A failure or delay by Nosizwe Concepts to enforce a term does not mean that the term has been waived.
The quotation, approved order, these Terms and Conditions, the Shipping Policy, Return and Refund Policy and Privacy Policy form the agreement between the customer and Nosizwe Concepts.
